1. INTRODUCTION

These Terms and Conditions ("Terms") constitute a legally binding agreement between FourPoint Couriers ("FourPoint", "Company", "we", "us", or "our") and any individual, business, organization, or other entity that accesses our website, establishes a customer account, submits a shipment, purchases a service, or otherwise uses or engages with any service provided by FourPoint ("Customer", "you", or "your).

FourPoint is a Jamaica-based courier and logistics company operating from Hopewell, Hanover, Jamaica, providing shipping and related logistics solutions for individuals and businesses. Our services include the transportation of goods from the United States of America to Jamaica by air and sea freight, package handling and processing, customer pickup, islandwide delivery, business shipping solutions, and the FourPoint Shipping Concierge service.

These Terms govern all services provided by FourPoint and apply regardless of whether a service is requested through our website at www.fourpointja.com, customer account portal, email, telephone, WhatsApp, social media, in person, or through any other communication channel authorized by the Company.

By creating an account, submitting or receiving a shipment, purchasing a service, providing shipping instructions, or otherwise using FourPoint's services, you acknowledge that you have had the opportunity to review these Terms and agree to be bound by them, together with any applicable service-specific terms, policies, rate schedules, and notices published by FourPoint.

Where a particular service is subject to additional terms, those terms shall apply in addition to these Terms. In the event of a conflict between these general Terms and a service-specific provision, the service-specific provision shall govern solely in relation to that service to the extent of the inconsistency.

1.1 Customer Eligibility and Authority

You must be at least eighteen (18) years of age, or otherwise have the legal capacity and authority to enter into a binding agreement.

Where a Customer is acting on behalf of a business, company, partnership, organization, or other legal entity, the person accepting these Terms represents and warrants that he or she has the requisite authority to bind that entity. References to "you" and "your" shall, in such circumstances, include the relevant entity.

1.2 Accuracy of Information

The Customer is responsible for providing complete, accurate, and current information to FourPoint at all times, including the Customer's name, telephone number, email address, billing information, shipping information, package details, declared value, and any information reasonably required for customs clearance or delivery.

FourPoint may rely upon information supplied by the Customer and shall not be responsible for delays, additional charges, misdelivery, customs issues, or other consequences arising from inaccurate, incomplete, misleading, or outdated information supplied by the Customer.

1.3 Compliance with Applicable Laws

The Customer shall comply with all applicable laws, regulations, customs requirements, carrier requirements, and import restrictions applicable to the Shipment.

The Customer represents and warrants that he or she has the lawful right to ship the goods entrusted to FourPoint and that the goods are accurately described and declared.

The Customer acknowledges that certain goods may be prohibited or restricted from importation into Jamaica or may require permits, licences, certificates, or other approvals before importation. FourPoint may refuse, suspend, hold, return, or otherwise deal with a Shipment where required to do so by law, customs authorities, carriers, regulatory authorities, or Company policy.

The Jamaica Customs Agency confirms that importers are responsible for providing accurate information concerning imported goods and obtaining required permits or licences before arrival. The importation of restricted goods without the required authorization may constitute a breach of the Customs Act.

1.4 Third-Party Service Providers

FourPoint may engage or utilize third-party freight forwarders, airlines, ocean carriers, customs brokers, warehouse operators, delivery providers, technology providers, payment processors, and other service providers in the performance of its services.

The Customer acknowledges that portions of the shipping process may therefore be performed by third parties whose operations, schedules, terms, requirements, and actions may be outside FourPoint's direct control.

FourPoint will exercise reasonable care in selecting and coordinating such service providers; however, nothing in these Terms shall be construed as a guarantee that the acts or omissions of an independent third party can be prevented or controlled by FourPoint.

1.5 Estimated Transit Times

Any delivery date, transit time, shipment schedule, or estimated arrival time communicated by FourPoint is an estimate unless expressly stated otherwise in writing.

Transit times may be affected by customs examinations or clearance requirements, airline or vessel schedules, weather, natural disasters, security procedures, government action, labour disruptions, congestion, mechanical failure, transportation interruptions, or other circumstances beyond FourPoint's reasonable control.

Accordingly, the Customer acknowledges that an estimated delivery date does not constitute a guarantee of delivery by that date.

1.6 Amendment of Terms

FourPoint reserves the right to amend these Terms where reasonably necessary to reflect changes in applicable law, regulatory requirements, operational procedures, services, technology, pricing, or business practices.

The current version of these Terms shall be made available on the Company's website. Where required by applicable law, FourPoint will provide appropriate notice of material changes.

Continued use of the Company's services after the effective date of an amendment shall constitute acceptance of the amended Terms, subject always to any rights the Customer may have under applicable law.

1.7 Severability

If any provision of these Terms is determined by a court or other competent authority to be unlawful, invalid, or unenforceable, that provision shall, to the extent necessary, be severed or modified without affecting the validity and enforceability of the remaining provisions.

1.8 Governing Principle

FourPoint is committed to conducting its operations with professionalism, transparency, accountability, and respect for its customers. Our services are guided by our commitment:

2. CUSTOMER ACCOUNTS AND CUSTOMER IDENTIFICATION

2.1 Mandatory Customer Account

A Customer must establish a FourPoint customer account before sending or arranging for the delivery of any Shipment to a FourPoint-designated United States shipping address.

Upon successful registration, the Customer will receive a unique Customer Identification Number ("Customer ID"), which must be used in accordance with FourPoint's shipping instructions.

The Customer ID enables FourPoint and its logistics partners to properly identify, attribute, process, track, and deliver Shipments to the correct Customer.

2.2 Packages Received Without a Customer Account

FourPoint is not obligated to accept, process, identify, or release a Shipment that arrives at a FourPoint-designated warehouse or receiving facility without sufficient information to associate that Shipment with an active Customer account.

Where a Shipment is received without a valid Customer ID, without an associated Customer account, or with insufficient identifying information such that additional investigation or manual processing is required ("Unknown Package"), FourPoint may undertake reasonable steps to identify the intended recipient.

Where the intended recipient is subsequently identified, the Customer shall be responsible for an Unknown Package Processing Fee of J$3,000.00 per Shipment, in addition to all applicable shipping, handling, storage, customs, delivery, or other charges.

The Unknown Package Processing Fee is intended to cover the additional administrative, identification, verification, data entry, communication, and processing work required to resolve a Shipment that was not properly associated with a registered Customer account.

Payment of the Unknown Package Processing Fee does not guarantee that a Shipment can be accepted, cleared, delivered, or released where the Shipment is otherwise prohibited, restricted, improperly declared, abandoned, or subject to legal or regulatory detention.

Customers are therefore strongly advised to complete registration and ensure that their Customer ID is correctly entered in the shipping address or shipment information before placing an online order.

2.3 Customer Responsibility for Account Information

The Customer must ensure that all information associated with the Customer's account remains accurate and current.

The Customer shall promptly notify FourPoint of any change to the Customer's name, telephone number, email address, delivery address, or other information reasonably required to administer the account.

FourPoint may request identification or additional documentation where reasonably necessary to verify the identity of a Customer or to comply with legal, customs, security, fraud-prevention, or regulatory requirements.

2.4 Account Security

Where the Customer is provided with login credentials, the Customer is responsible for maintaining the confidentiality of those credentials and for all activity conducted through the Customer's account, except to the extent that such responsibility cannot lawfully be imposed.

The Customer must immediately notify FourPoint if the Customer suspects unauthorized access to the account.

FourPoint reserves the right to suspend or restrict an account where it reasonably suspects fraud, misuse, unauthorized activity, inaccurate information, violation of these Terms, or any activity that may expose FourPoint, its customers, or its service providers to legal, financial, operational, or security risk.

3. FOURPOINT SHIPPING CONCIERGE

3.1 Nature of the Service

The FourPoint Shipping Concierge ("Shipping Concierge") is an optional purchasing assistance service offered by FourPoint to customers who wish to purchase goods from participating or supported online retailers but may not have access to a suitable credit card, debit card, or other accepted international payment method.

Where the Customer elects to use the Shipping Concierge, FourPoint may, subject to availability and acceptance of the request, place the online order on the Customer's behalf using the information and funds supplied by the Customer.

The Shipping Concierge is a purchasing assistance service and is separate from FourPoint's ordinary freight forwarding and shipping charges.

3.2 Customer Order Information

Before an order is placed, the Customer must provide FourPoint with complete and accurate information concerning the requested purchase, including, where applicable:

  • the retailer or website;

  • product name or description;

  • product link;

  • size, colour, model, quantity, or other specifications;

  • shipping address where applicable;

  • any applicable promotional code or discount;

  • the Customer's preferred delivery or collection arrangements; and

  • any other information reasonably required to complete the purchase.

The Customer is responsible for reviewing the order details and confirming that the information supplied is correct before FourPoint places the order.

3.3 Payment Before Order Placement

Full payment for the purchase must be received and cleared by FourPoint before the order is placed with the retailer.

The amount payable by the Customer may include, as applicable:

  1. the purchase price of the goods;

  2. applicable sales tax charged by the retailer;

  3. retailer shipping charges;

  4. the FourPoint Shipping Concierge service fee;

  5. any other charges expressly disclosed to the Customer before the order is placed.

FourPoint will not be required to place an order until the required funds have been received in full.

3.4 Shipping Concierge Service Fee

A non-refundable service fee of US$5.00 per order applies to each order placed through the FourPoint Shipping Concierge.

The service fee is payable before the order is placed and is separate from the cost of the goods, retailer shipping charges, FourPoint shipping charges, customs duties, taxes, delivery charges, and any other applicable fees.

The Shipping Concierge service fee compensates FourPoint for the administrative and purchasing assistance involved in processing and placing the Customer's order and is therefore non-refundable once FourPoint has commenced processing the order, subject to any rights or remedies that cannot lawfully be excluded.

3.5 Product Availability and Pricing

FourPoint does not guarantee that an item will remain available at the price displayed by a retailer.

Online retailers may change prices, impose purchasing limits, substitute products, cancel orders, remove promotional discounts, or otherwise alter the terms of a transaction without notice.

Where the final amount required to complete an order differs from the amount originally quoted, FourPoint will notify the Customer where reasonably practicable. FourPoint shall not be required to place the order unless the additional amount, where applicable, has been paid.

3.6 Retailer Cancellations, Substitutions and Refunds

Where an online retailer cancels an order, issues a partial refund, substitutes an item, or otherwise alters the transaction after FourPoint has placed the order, FourPoint will communicate the applicable information to the Customer and, where funds are actually received by FourPoint from the retailer, apply or remit such funds in accordance with the circumstances of the transaction and applicable law.

FourPoint is not responsible for a retailer's failure to fulfil an order, incorrect product descriptions, manufacturing defects, retailer shipping delays, retailer cancellations, or other matters attributable to the retailer, except to the extent caused by FourPoint's own failure to exercise reasonable care in performing the Shipping Concierge service.

3.7 Customer Responsibility for Product Selection

The Customer is solely responsible for selecting the correct product, size, colour, quantity, model, specifications, and other characteristics of the goods requested.

Once an order has been submitted to the retailer, FourPoint may be unable to cancel, amend, exchange, or substitute the goods.

Customers should carefully review all order details before authorizing FourPoint to proceed.

3.8 Returns and Exchanges

Returns, exchanges, warranty claims, and refunds relating to goods purchased through the Shipping Concierge are subject to the applicable retailer's policies.

Where a retailer permits a return or exchange, the Customer may be responsible for all applicable return shipping costs, restocking fees, price differences, retailer charges, and FourPoint handling or shipping charges associated with returning or replacing the item.

FourPoint does not guarantee that a retailer will accept a return, exchange, refund, or warranty claim.

3.9 Prohibited and Restricted Goods

The Shipping Concierge shall not be used to purchase goods that FourPoint is prohibited from purchasing, importing, transporting, or handling under applicable law, carrier requirements, customs requirements, or Company policy.

The Customer is responsible for ensuring that requested goods may lawfully be imported into Jamaica and that any required permit, licence, certificate, or approval is obtained.

The Jamaica Customs Agency advises importers to verify permit and certification requirements before purchasing goods online and notes that importing restricted goods without the required authorization may constitute a breach of the Customs Act.

FourPoint reserves the right to decline any Shipping Concierge request where the requested goods are prohibited, restricted, unavailable, commercially impractical, or reasonably considered to present a legal, customs, safety, fraud, or operational risk.

3.10 Shipping Charges Remain Separate

Payment for goods through the Shipping Concierge does not constitute payment for the transportation of those goods from the United States to Jamaica.

Once the goods are received at the FourPoint-designated receiving facility, the Customer remains responsible for all applicable FourPoint shipping charges, customs charges, delivery fees, storage fees, and other applicable charges before release or delivery of the Shipment.

3.11 No Guarantee of Delivery Date

FourPoint does not guarantee a particular delivery date for goods purchased through the Shipping Concierge.

The order must first be accepted and fulfilled by the retailer before the goods enter FourPoint's shipping process. Thereafter, ordinary shipping, customs, and delivery timelines apply.

4. ACCEPTANCE OF THESE TERMS

By registering for a FourPoint account, submitting a Shipment, authorizing FourPoint to place an order on your behalf, paying for a service, or otherwise using FourPoint's services, you acknowledge that you have read and understood these Terms and agree to comply with them.

If you do not agree to these Terms, you must not use FourPoint's services.

Nothing in these Terms is intended to exclude, restrict, or limit any right, remedy, liability, or obligation that cannot lawfully be excluded, restricted, or limited under the laws of Jamaica.
